These terms apply to all users in Australia and the United Kingdom.
Animo is an online tutoring service that provides educational content, tutoring sessions and related digital resources for students.
You must use the website lawfully and avoid any activity that disrupts its operation or security. You must not upload, share or transmit any harmful, unauthorised or inappropriate content.
If you are under 18, you may only use the website with permission and supervision from a parent or guardian.
Some features may require creating an account. You are responsible for keeping your login details confidential.
If you believe your account has been compromised, you must notify us immediately.
Where the student is under 18, a parent or guardian must create, control and manage the account, including payments and communication with Animo.
All content on the website, including text, graphics, logos, videos and course materials, is owned or licensed by Animo.
You may not copy, reproduce, modify, distribute or use any content without written permission.
Any documents, homework or materials you upload remain yours, but by submitting them you grant Animo permission to use them for tutoring, support and quality improvement.
Tutoring fees will be confirmed via email before your first lesson.
Where applicable, fees for tutoring services or paid content will be displayed clearly before purchase. By making a payment, you confirm that the payment details you provide are accurate and authorised.
If you add a payment card to your account, it will be used as your default payment method unless updated. You agree that charges may be processed automatically using this method.
All tutoring fees are charged in Australian Dollars for users in Australia and British Pounds (GBP) for users in the United Kingdom. GST or VAT will be added where required by law.
Tutoring packs purchased through your client account are non-refundable. Unless required by law, individual lesson payments are also non-refundable.
If a payment fails, lessons may be paused until payment is received. Unused prepaid lessons may expire after 12 months unless otherwise stated.
If you cancel a lesson within 24 hours of the scheduled start time, the full lesson fee, inclusive of GST or VAT where applicable, will be charged. This applies in both Australia and the United Kingdom.
If you do not attend a scheduled lesson and have not cancelled, the session will be treated as a late cancellation.
If Animo needs to cancel a lesson, you will not be charged and we will help you arrange a new time.
Rescheduling within 24 hours is treated as a cancellation unless agreed otherwise.
Lessons may be recorded for safety, quality and training purposes. Recordings help us review lesson delivery and maintain a safe environment for tutors and students. By using our tutoring services, you consent to lessons being recorded.
Recordings are stored securely and retained for 12 months for compliance, training and safeguarding. They will only be shared externally if required by law.
We aim to keep the website available at all times, but uninterrupted access cannot be guaranteed. We may suspend or update the site for maintenance or technical reasons.
Tutor availability may change. If your usual tutor is unavailable due to sickness, scheduling changes or other reasonable circumstances, Animo may assign a different tutor. We do not guarantee the same tutor for every lesson.
We are not responsible for technical faults on the user’s side, including internet or device issues.
The website may include links to external sites. We are not responsible for the content, accuracy or policies of those sites.
To the maximum extent permitted by law, Animo is not liable for any loss, damage, interruption or disruption arising from your use of the website or tutoring services.
Nothing in these terms limits your rights under Australian Consumer Law or UK consumer protection law.
You are responsible for ensuring the information you provide is accurate.
Students and parents must ensure the learning environment is safe, appropriate and free from interruptions.
A parent or guardian should be present in the home during tutoring sessions for students under 18.
You must not misuse tutoring services or engage in behaviour that is abusive, harmful, inappropriate or disruptive. This includes discriminatory language, harassment and any behaviour that affects the safety or wellbeing of tutors or students.
Your personal information is handled in line with our Privacy Policy, available on our website.
If you have a complaint or dispute, please contact us and we will aim to resolve it promptly.
Australian users may raise disputes with the relevant state consumer protection authority. UK users may raise disputes with Trading Standards.
We may suspend or terminate your account or access to services if you breach these terms, or if required for security, legal or operational reasons.
We may update these terms occasionally. Any changes take effect when posted on the website. Continued use of the site means you accept the updated terms.
For users in Australia, these terms are governed by the laws of the relevant Australian state or territory. For users in the United Kingdom, these terms are governed by the laws of England and Wales.
